At least here in Canada it has already been legally established that everyone has the right to access needed medical care in a timely manner and government policy may not interfere in that process.

The SMS system cannot be fixed in part because the protocol has confirmations for the passing of messages from server to server (so these could be strengthened to by cryptographically secure if, as I suspect, they are not now), but the final link, to the mobile device, is fire-and-forget, with no confirmation or authentication possible.  Fixing this would require rebuilding the connection between the end devices and the rest of the network, entirely breaking all extant devices.

There are reports that when Gabrielle Giffords was shot in the head in 2011 (along with 19 other people, six of whom died as a result) an armed citizen pulled their gun out and was momentarily mistaken for a possible shooter.  Mind you, that was in Arizona, which is one of the most liberal states when it comes to gun rights.  (This is the state where the universities allow concealed carry on campus.  Incidentally, here's a reason to suspect the very worst of Giffords:  She's claimed to be a close friend of Debbie Wasserman Schultz.)

That's why Open Whisper Systems gave up on using SMS for Signal's encrypted texts and used the data network and their own servers instead.
